Eminent Domain
KSGA&D has practiced eminent domain and condemnation law for 30 years in DuPage County and its surrounding counties. In that time, we have successfully handled hundreds of eminent domain matters, representing both local governments as well as individual property owners.
Eminent domain (also known as "condemnation") is the power of government agencies to acquire property for public use as long as government pays just compensation to the property owner. A government can exercise its power of eminent domain even if the owner does not wish to sell his or her property. The Fifth Amendment of the United States Constitution provides that private property may not be taken for a public use without payment of just compensation.
Eminent domain / condemnation law is different from other types of litigation. Specific and unique requirements are placed on the local government when attempting to take private property for public use. When representing municipalities and park districts, KSGA&D makes sure the city does what is legally required to succeed in acquiring property legally at a fair price. When representing individual property owners, we first determine that the public agency is following all of the procedures it is legally required to follow and then fight to assure that the client receives the maximum compensation he or she is entitled to receive under the law.
